1. Introduction

Welcome to Fans API, a service provided by Fans Holdings OÜ ("Company", "we", "us", or "our"). Fans API provides an independent API service that enables users to integrate with third-party social media platforms. We are not affiliated, associated, or endorsed by any third-party platform or their parent companies. By accessing and using fansapi.com ("Website"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our service.

2. Pricing & Service Changes

We reserve the right to change our pricing structure at any time, with or without prior notice. Continued use of our service after such changes constitutes acceptance of the new pricing terms.

3. Independent Organization & No Affiliation with Third-Party Platforms

Fans API is an independent entity and has no formal relationship with any third-party platform or their parent companies. We do not provide or distribute any content; the API usage is solely the responsibility of our customers. Nothing in our service should be interpreted as an endorsement, partnership, or affiliation with any third-party platform.

4. Compliance Responsibility & Third-Party Platform Terms of Service

Customers are responsible for ensuring their use of Fans API complies with all applicable laws and regulations. We do not guarantee compliance with any third-party platform's Terms of Service. Users must ensure that their usage of our API does not violate any policies set by the supported platforms. We are not liable for any legal consequences arising from third-party usage of our API. Users are prohibited from using Fans API to: Automate actions that mimic real user behavior (e.g., bulk messaging, mass following/unfollowing). Scrape, download, redistribute, or store content from third-party platforms. Bypass paywalls, security features, or DRM protections implemented by third-party platforms. Engage in fraudulent, unlawful, or deceptive activity on any supported platform. Users accessing our services from different jurisdictions are responsible for ensuring compliance with local laws. We are not responsible for any account suspensions, terminations, or penalties imposed by third-party platforms as a result of the use of Fans API.

5. No Liability for Third-Party Content

Fans API provides an API service but does not control, verify, or moderate third-party content. We are not responsible for age verification or record-keeping obligations of third-party sites.

6. Service Level Agreement (SLA)

We commit to a 99.9% uptime guarantee. We do not provide compensation, refunds, or discounts for service downtime. Updates and maintenance may impact service availability, and we will strive to notify customers in advance.

7. Ethical and Social Responsibility

We are committed to ethical business practices. Users must not use our service for illegal, unethical, or harmful purposes. We reserve the right to terminate access for violations of these principles.

8. Warranty Disclaimer

Our service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Dispute Resolution

Limitation Period for Bringing Claims Claims or legal actions must be filed within one year from when the issue arose or when you became aware of it. After this period, claims are waived. Users must notify us before initiating legal action and agree to pre-suit mediation if requested. This provision is a material inducement to allow you to use our service. If a user initiates proceedings against us, we may terminate their account to minimize risks to Fans API and our community. Legal documents must be served in accordance with Estonian law. We do not accept service in any other manner. Failure to comply with this section constitutes a material breach of these Terms.

10. Intellectual Property Rights & DMCA Compliance

All content on our Website, including branding, documentation, and API design, is copyrighted and may not be reproduced without our explicit permission. Unauthorized use of our trademarks, logos, or branding is strictly prohibited. Fans API does not distribute, host, or store any third-party content. Users who violate copyright laws using our API bear full responsibility. We will cooperate with DMCA takedown requests as required. If a copyright holder believes their content is being misused via Fans API, they may contact us at hello@fansapi.com to request removal.

11. Security Measures

We employ security measures to protect our platform, but we cannot guarantee it is entirely free from malicious threats. Users should maintain their own antivirus and cybersecurity protections.

12. Limitation of Liability

Under no circumstances shall FansAPI or its affiliates be liable for: Direct, indirect, incidental, punitive, or consequential damages arising from the use of our services. Any loss of data, revenue, or business opportunities resulting from reliance on our API. Any damages exceeding the amount paid for our service in the last 12 months preceding the claim. Any bans, suspensions, or account restrictions imposed by third-party platforms due to API usage.

13. Indemnification

Users agree to indemnify and hold harmless Fans Holdings OÜ, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from: Misuse of the API. Violation of these Terms. Any third-party claims related to actions taken using our service.

14. Modification of Terms

We reserve the right to update these Terms at any time. It is the user's responsibility to review them periodically. Continued use of our services after modifications implies acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Governing Law & Jurisdiction

These Terms shall be governed by the laws of Estonia. Any disputes shall be resolved exclusively in the courts of Tallinn, Estonia.
